Official Rules

Introduction
The Cheapedia Cheapstakes (”Sweepstakes”) is hosted by Cheapedia.com (”Cheapedia”). The prize (”Prize”) is listed on the appropriate sweepstakes entry page and is sponsored by Cheapedia unless another company is listed as the sponsor (”Sponsor”) on that same page. One (1) winner will be selected in a random drawing from among all entries received for each prize offered in the Sweepstakes. The odds of winning depend on the number of entries received during the Promotion Period, as defined below. The Sweepstakes is offered electronically, via the Internet and only within the United States, except where otherwise prohibited by law.
Eligibility
The Sweepstakes is open to legal U.S. residents 18 years of age or older at the time of entry. Employees, officers and directors of Cheapedia, Sponsors and Promoters, their respective parents, subsidiaries, and agents, their immediate families (defined as parents, spouses, children, siblings and grandparents) and those with whom such persons are domiciled are NOT eligible. By participating, entrants agree to abide by these Official Rules, including all eligibility requirements, and the decisions of Cheapedia. All of Cheapedia’s decisions are final and binding in all respects. In the event of a dispute as to the identity of an online entrant, entries made online will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Potential winners may be required to show proof of being the authorized account holder for that e-mail address. “Authorized account holder” is defined as the natural person assigned to an e-mail address by an Internet service provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain.
How to Enter
To enter, visit Cheapedia, http://www.cheapedia.com, and follow the instructions and links accompanying the Sweepstakes post. Cheapedia, Sponsors and Promoters are not responsible for incorrect or inaccurate transcription of entry information, late, lost, stolen, illegible, incomplete, misdirected, or postage due entries, or entries received through impermissible or illegitimate channels. Additionally, Cheapedia, Sponsors and Promoters are not responsible for any human error, lost/delayed data transmission, or omission, interruption, deletion, problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, or injury or damage to any computer related to or resulting from participation or downloading any materials in the Sweepstakes. Cheapedia reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Cheapedia or Promoters, in Cheapedia’s sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Cheapedia may elect to award the prizes to winners drawn from among all participants who have played the Sweepstakes at the time of cancellation. Any attempt by an entrant to deliberately damage Cheapedia’s or any Promoter’s Web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, Cheapedia and Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law.
Timing
The Cheapstakes Period (”Sweepstakes Period”), i.e. run-time, for each prize offering is displayed on the appropriate sweepstakes entry page. One (1) potential winner for each prize will be drawn on or about 24 hours from when all entries have been received on the end date of the Sweepstakes Period of that prize. The drawing (”drawing”) will be conducted by Cheapedia utilizing the services of Random.org.
Prize
One (1) prize will be awarded for each prize offered in this Sweepstakes. The prize for which an entrant is eligible depends on which Sweepstakes the entrant has entered according to the rules outlined in this document as well as specific instructions for each Sweepstakes. Total retail value for prize and method of redeeming, obtaining and/or acquiring prize may also be listed on the same page. Prizes cannot be exchanged or returned for other prizes, Sponsor merchandise, or cash, or for reasons of dissatisfaction upon winner’s receipt of (non-damaged) prize(s), unless specifically stated on the prize’s entry page or at the sole discretion of the Sponsor.
Unclaimed or forfeited prize will not be awarded.
Winning
The potential winner(s) will be announced by their registered Cheapedia username via www.cheapedia.com. The potential winner will also be notified via an email to their registered Cheapedia email address. Entrants must check to see if Entrant is the winner. If any potential winner cannot be contacted within 7 days of the first attempt, or if any potential winner fails to comply with these Official Rules, that potential winner forfeit the prize(s). Acceptance of a prize constitutes permission for Cheapedia.com to use the winner’s name and likeness for advertising and promotional purposes without compensation, unless prohibited by law.
Privacy
Cheapedia does not sell its Member list.
Additional Terms
By accepting a prize, winner agrees that Cheapedia, Sponsors and Promoters, their respective parents, subsidiaries and affiliated companies, and the agents, employees, directors or officers of these companies, are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of any prize. Winner is responsible for any applicable taxes on prize, including luxury tax if any. All entries are the property of Cheapedia, and none will be returned. Neither Cheapedia, Sponsors nor Promoters are responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from downloading any material from Cheapedia, Sponsor’s or Promoter’s Web site, regardless of whether the material was prepared by Cheapedia, Sponsors, Promoter, or a third party, and regardless of whether the material is connected to Cheapedia’s, Sponsor’s or Promoter’s Web site by a hypertext link. Participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Massachusetts or the appropriate Massachusetts State Court located in Los Angeles County, California; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys” fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSIONS MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant, Cheapedia, Promoter and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Masschusetts, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Masschusetts, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Masschusetts. All federal, state and local laws apply.
